Fees for the Land Title and Survey Authority of British Columbia's (LTSA) land title and survey services changed on November 1, 2015.

The new regulated fee structure, which reflects Provincial legislative action and a determination by an independent Fee Commissioner, reduces the number of LTSA fee categories and better aligns the level of effort with the cost of the service.

The result is a simplified customer fee listing that reflects the current services provided by the LTSA.

Why did LTSA fees change?

The previous LTSA customer fee listing is long and complex. Many of the fees applied to services no longer relevant in today’s electronic transaction environment. As part of the BC Government’s initiative to reduce red tape, it amended Schedule 2 of the Land Title Act to simplify a major component of the LTSA fee listing. Additional work was undertaken to simplify the approach to the remaining components of the LTSA’s regulated fee structure.

The new fee listing is easier to reference and administer.

How does the new fee listing apply to applications?

Any application submitted on or after November 1, 2015 will incur the new fees.

If you have a land title application or Surveyor General submission, the fees payable will be determined by:

  • The date of the electronic filing submission
  • The date the application is received at the land title office or Surveyor General office

How did fees for searching and accessing land title records change on November 1, 2015?

Similar transactions have been grouped together into the same fee category. Information products fees (search and retrieval) no longer vary by ordering method or location.

As noted on the Fees page, the new fees for the most common information products are as follows:

Searches

  • Title Search, Name Search, Mortgage Terms Search, Charge Terms Search, Strata Plan General Index Search, and Power of Attorney Search are represented by the Searches fee category, with a fee of $9.45*
  • An in-person or mailed request for a copy of an electronically stored, hard copy, or microfilmed search trigger the following fees:
    • Searches fee of $9.45*, inclusive of printing at the land title office
    • Mailing fee of $2.00* per envelope (where applicable)

Certification

  • Requests for a State of Title Certificate and other land title office certifications are represented by the Certification category with a fee of $14.31*, inclusive of mailing

Retrieval of Images (Documents or Plans)

  • Online image retrieval of land title documents and plans, available in digital format, are represented by the Retrieval of Images fee category with a fee of $15.18*
  • An in-person or mailed request for a copy of an electronically stored document or plan from the land title office triggers multiple fees depending on the services requested:
    • Retrieval of Images fee of $15.18*
    • Printing fee of $1.10* per page
    • Mailing fee of $2.00* per envelope (where applicable)
  • Requests for a hard copy or microfilmed document or plan from the land title office can only be made in person, or through a registry agent. The request triggers multiple fees depending on the services requested:
  • Manual Location and Retrieval of Record fee of $35.00* to locate and retrieve the document or plan. This fee only applies if the request is fulfilled by an LTSA employee
  • Electronic Images fee of $15.18*
  • Printing fee of $1.10* per page
  • A Scan on Demand request for plans submitted through myLTSA Enterprise incurs the following fees:
    • Manual Location and Retrieval of Record fee of $35.00*
    • Electronic Images (Surveyor General) or Retrieval of Images (Land Title) fee of $15.18*

It is recommended that requests for the retrieval of hard copy or microfilmed records from the land title office be performed by a registry agent. Requests will be subject to the fees charged by the agent.

How did fees for land title applications change this fall?

The new fee listing no longer contains a difference in fees between electronically or manually filed applications. The most common applications see a decline in fees.

The new fees for some of the most common applications are as follows:

Indefeasible Title

  • Applications represented by the Indefeasible Title category have a fee of $71.58*

Charges

  • Applications represented by the Charges category have a fee of $71.58*
  • Applications pertaining to the Builders Lien Act have a fee of zero dollars*

General Filing, Amendment, or Change of Address

  • Applications represented by the General Filing or Amendment have a fee of $28.63*
  • A Change of Address application have a fee of zero dollars*

Cancellation of a Charge

  • Applications represented by the Cancellation of a Charge category have a fee of $28.63*
  • Cancellations of Claims of Lien pertaining to the Builders Lien Act have a fee of zero dollars*

Plans

  • Applications represented by the Plans category have a fee of $89.96.*
  • The submission of posting plans under section 68 have a fee of zero dollars*

Did land title forms change as a result of the new fees?

No, land title forms did not change as a result of the change in fees on November 1, 2015.

How did fees for transactions with the Surveyor General change?

Applications and plans submitted to the Surveyor General fall under various legislation. The several types of applications whose fees appear in Schedule 2 of the Land Title Act all fall under a single Surveyor General Services category, with a fee of $449.79. Within this new category, fees are now charged for applications to the Surveyor General for designations to hold statutory rights of way under section 218, or covenants under section 219 of the Land Title Act.

Fees for applications to the Surveyor General under section 58 of the Land Act, or section 108(3) of the Land Title Act, see an increase to $702.39*.

The fees for other plans and applications submitted to the Surveyor General (such as Land Act or Land Title Act plans over Crown land, and plans prepared under the Mineral Tenure Act or the Oil and Gas Activities Act) remain substantially unchanged.

Fees for the retrieval of records from the Surveyor General have changed to align with those of Land Title Services, and there will no longer be different fees charged for different types of Surveyor General records. Typical requests received in person, over the phone, via email or via myLTSA are subject to the following fees depending on the services requested:

  • Manual Location and Retrieval of Record fee of $35.00* to locate and retrieve the record
  • Electronic Images fee of $15.18*
  • Printing fee of $1.10* per page
  • Mailing fee of $2.00* per envelope (where applicable)

Did the myLTSA service charge change with the November 1 fee change?

The myLTSA Enterprise service charge remains $1.50* per transaction. The myLTSA Explorer service charge remains $2.50* per transaction.

Will the way billing information appears on myLTSA Enterprise financial statements change?

myLTSA Enterprise statements in .csv format continue to display the natures of interest for applications, while search transactions are listed as “Searches”. Read the news announcement about changes to myLTSA account statements and to download a list of product names.
