Limited Right to Use

This website contains proprietary information and material that is owned or controlled by the LTSA, its subsidiaries, affiliates and/or licensors, and is protected by applicable intellectual property and other laws, including but not limited to copyright and trademarks. Without limiting the foregoing, the Content and the Services are protected under applicable copyright, trademark and other proprietary (including but not limited to intellectual property) rights. You acknowledge and agree that you will not use such proprietary information, materials or Content in any way except for use of the Services and website in compliance with these Terms. All rights in the website, the Content and the Services are reserved worldwide and the copying, redistribution, use or publication by you of any of same beyond the scope of the limited license hereunder is strictly prohibited. The website contains trademarks, service marks, logos, icons and trade-names (collectively, “Trademarks”) that are the property of the LTSA, or such other party as is indicated with respect to that Trademark. Fees for Services

Certain Services on the website are subject to the payment of fees, third party charges, and applicable taxes (collectively, “Fees”).

With respect to Fees incurred by you for the Services, you agree that:

  1. the Fees are payable by such methods as are accepted by LTSA, which methods may vary from time to time, and are payable when Services are requested;
  2. you will pay to the LTSA all Fees for the Services requested by you;
  3. Fees may be paid through a third-party electronic payment processor and you will receive a transaction ID confirming the payment from the electronic payment processor;
  4. all Fees are in Canadian dollars and will be processed in Canadian dollars; and
  5. all Fees are non-refundable, except Fees established by the LTSA and the Province of British Columbia under or in accordance with an enactment for applications to the land title office that are withdrawn or cancelled prior to registration.

If you fail to notify the LTSA of errors or objections to any credit card charge for Fees within 45 days after the transaction date, the charge will be conclusively deemed to have been accepted as correct by you and no claim for credit, adjustment or set-off may be advanced against the LTSA.

Availability and Access to Services

The LTSA may at any time suspend the operation of this website, the Services or all or any of the Content for any period of time without any prior notice, whether for the purposes of Site updating and upgrading or system maintenance or otherwise. This site, the Services and the Content may be modified, deleted, edited or withdrawn by the LTSA at its absolute discretion and at any time without prior notice.

We reserve the right to immediately suspend or terminate your access to the Services for any reason whatsoever without notice to you and without prejudice to other remedies that we may have.  For example, we may suspend or terminate your use if we believe you have not complied with these Terms.  We will not be liable to you or any other person for termination of your access to the Services.

Limitation of Liability and Indemnity

The LTSA, its directors, officers, employees, contractors, agents and other representatives will not under any circumstances be liable to you or any other person for any damages of any kind including, without limitation, direct, indirect, general, special, consequential or incidental damages arising from your use of this website , the Content or the Services, whether or not such damages might be foreseeable and even if the LTSA is informed of the possibility of such damages.

You will indemnify, save and hold harmless the LTSA and its directors, officers, employees, contractors, agents and other representatives against any and all liabilities, losses, claims, damages, actions, causes of action, costs and expenses that any person may sustain, incur, suffer, or be put to by reason of any use by or on behalf of you of this website, the Content, the Services or the results of the Services or any breach of these Terms by you.

You will be liable to the LTSA for all damages suffered by the LTSA, directly or indirectly, as a result of a breach by you, or any person or entity under your control, of a term or condition of this Agreement. Damages will include losses or damages of any kind suffered by the LTSA, including, without limitation: all costs put to the LTSA related to the repair of any such matter; loss of income, revenue, savings or profit; and any cost related to business interruption or slowdown of computer system or any other LTSA system.

Third-Party Content

The website, Content or Services may contain information and materials provided to the LTSA by third parties (collectively, “Third-Party Content”). Third-Party Content may be copyrighted work of its owner, who retains all right, title and interest in and to the Third-Party Content, including, without limitation, all intellectual property rights therein and thereto. Any and all Third-Party Content will be subject to these Terms to the same extent as the Content. In addition to being subject to these Terms, Third-Party Content may also be subject to different and/or additional terms of use and/or privacy policies of such third parties.

The LTSA respects your personal privacy. Your continued use of the website and Services following our posting of any changes to these Terms means that you accept those changes.  If you do not agree, you must immediately stop using the website and the Services.

Our failure to enforce or insist upon strict compliance with any rights under these Terms does not waive our right to enforce such rights. Any waiver of our rights will only be effective if it is in writing and signed by us.
