The Director of Land Titles has published updates to the Land Title Electronic Application to Deposit Plan Help Guide. The change clarifies that holders of an Assignment of Rents charge, when it forms part of the same Form B Mortgage, may provide consent to an extension under Section 100(5) of the Land Title Act.
To process this:
- Open the “Schedule of Owners and Witnesses” tab on the Application to Deposit Plan
- Select “Consents by Registered Holders – Section 100(4)”
- Enter the mortgage and assignment of rents charge numbers in the editable fields.
This update ensures assignment of rents holders can appropriately sign the application.
