File a Judgment

To register a judgment against property, you’ll need the following:

1. Certificate of Judgment 

   You must attach the original certificate of judgment issued by the court to your application. This certificate must be:

   1. Sealed with the official seal of the court where the judgment was made.
   2. Signed by the court registrar (or, for Provincial Court judgments, certified as a true copy by the clerk or judge).
2. Form 17 – Charge, Notation or Filing 

   Complete a Form 17, which is an application used to register various types of interests against a land title.

   1. On the form, under Nature of Interest, write “Judgment.”
   2. Ensure the form is completed clearly and accurately.
3. Submit the Application
   1. Electronic Filing by Legal Professionals: The Director of Land Titles mandates that judgments must be filed electronically by a legal professional. This ensures accuracy and compliance with legal requirements.
   2. Exception for Self-Represented Individuals: In exceptional circumstances, individuals may obtain permission to file a judgment without legal representation by submitting an exception letter. Guidance on preparing this letter can be found in the E-filing Directions, section 6.3.
   3. Approval Required: If an exception is granted, the individual must follow the specific requirements to file a judgement set out on this page.
