Looking for ways to help complete land title transactions more easily and accurately? LTSA recommends the following customer practices that may reduce manual intervention and support faster, automated processing times:
Use of the Web Filing Form, Declaration s. 49 Affidavit (also known as Affidavit of Witness Declaration)
Use the Declaration s. 49 Affidavit Web Filing form in situations where an instrument has not been witnessed under Part 5 of the Act — for example, when it is executed outside of BC.
- The form is available in Enterprise by adding Affidavit of Witness Declaration
- When users select “The instrument was executed outside British Columbia” this preapproved selection accepted by the Registrar of Land Titles qualifies the application for automated registration within 48 business hours.
- The form must still be printed and signed, but under section 3.3.8 of the E-filing Directions, the subscriber may retain a true copy instead of the original.
By using this form appropriately, customers can avoid delays caused by manual review and support faster, automated outcomes.
