Practice Note 2-16: Truing up an Original Electronic Instrument

Practitioners are reminded Practice Note 2-16 outlines the methods for truing up an electronic instrument. Truing up the execution section of an electronic instrument is expected and acceptable since the particulars in the instrument are not typically known when it is initially prepared.

To maintain compliance with the Land Title Act, the following truing up principles apply:

  • The execution copy must be a print of the electronic instrument.
  • There must be one electronic instrument for each execution copy.
  • Creating a new electronic instrument based on the content of a printed hardcopy form does not make the printed form an execution copy.
