Changes to Statutory Right of Way Applications Now In Effect
As announced on August 13, 2020, changes to Statutory Right of Way (SRW) applications affecting land within the Agricultural Land Reserve (ALR) are now in effect.
Legal practitioners are reminded that any Form C Charge SRW application affecting land within the ALR must be accompanied by a Declaration form that appends the Notice of SRW response form issued by the Agricultural Land Commission. The Registrar will not accept any SRW applications affecting land within the ALR that do not meet these requirements.
Land surveyors are reminded this practice change does not impact the filing of SRW plans separate from the charge document. However, if the plan forms part of a package with the charge document, then proof of the ALC notice is required and must be provided to the Registrar.
Customers can create the Notice of SRW within the ALC’s online Application Portal by contacting the Agricultural Land Commission(link is external).
In support of these Agricultural Commission Act amendments, the Director of Land Titles has also updated the E-filing Directions to allow the designate to have possession of a true copy of the Notice of Statutory Right of Way response form rather than the original supporting document. The following forms have also been updated and are in effect immediately:
Web Filing Forms:
- Form 17 Charge, Notation or Filing
- Form 17 Cancellation of Charge, Notation or Filing
- Form C Charge
PDF Versions of Forms:
Also revised are the Authorized Subscriber Register Membership Terms and Conditions:
- Non-substantive changes made to the Organization Terms and Conditions and Candidate Terms and Conditions by removing reference to “DR 01-13 Director’s Requirements for membership in the Authorized Subscriber Register” and replacing with “Director’s E-filing Directions”
